Terms and Conditions

 There is no understanding between the parties verbal or otherwise than contained in this agreement and the proposal. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought must have signed the waiver in writing.

  1. Payments – Full payment is due upon booking.

  2. Participants – To ensure a calm environment, please bring only those persons who will be photographed or involved in your session.

  3. Shooting Session – The client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. If the client has special requests shall create a “short list” of all shots that they require and share it with the photographer prior shooting date.

  4. Time Required – session period is pre-determined by the original proposal.
    The client should attempt to provide PHOTOGRAPHER with adequate time to perform the photo shoot portion.
    If a Make-Up service was part of your package the time required is part of the original duration. The client should not ask for an extended time because of makeup work. 
    PHOTOGRAPHER will also not be responsible for photos that are not completed due to the possibly uncooperative nature of the individuals to be included in any photographs. It is the client’s responsibility to inform all participating parties, that the photos are occurring and as to where and when.

  5. Delivery of Unedited Photos – 4Dimensions studio Dmcc will deliver all the raw photo(s) to the client through a privet online gallery within 24 hours and the client is encouraged to quickly pick their favorite photo(s) for final retouching (the quantity is determined by the client package).
    Live Gallery will be available within 40 days of the above-stated service.
    The client will receive a set of images in JPEG format only.

  6. Final Retouching – 4Dimensions studio Dmcc will deliver the final edited images within 8-10 days from the selection date. Images will be edited for exposure, tone, colour and minor skin retouching blemish removal, eye brightening, teeth whitening, contouring and general editing to contrast, levels, and saturation. If additional adjustments are needed, the PHOTOGRAPHER will recommend they be sent off-site for extensive retouching and charged a per-image rate. The client agrees that they are familiar with the Photographer’s work as displayed on their website and Facebook page and agrees to accept the editing choices of the Photographer and abide by the editing style the Photographer chooses for the specific conditions of the session. Online Proof Gallery is available for the client’s comments and instructions.

  7. Retouched Photos Quantity – the quantity is determined by the client’s chosen package. The client’s choice of image selection is final. Additional editing can be requested but incur additional charges (25 AED extra charge per image).

  8. High-Resolution Files – Where the ownership of the high-resolution digital files is included with the package, you agree to assume full responsibility for the care and condition of said digital files. PHOTOGRAPHER recommends storing copies in several locations, including off-site storage. PHOTOGRAPHER is not responsible for the colour reproduction of enlargements from these files that have been taken to non-professional and/or consumer-type labs. PHOTOGRAPHER will keep a copy of these files for 1 year after the date of the above-stated service. 

  9. Continuous Hours – this contract covers the hours specified on a continuous basis. Overtime requests on the day of the wedding will be signed and approved by either member of the booking party as stated above and payment will be due upon delivery of the proofs.

  10. DO NOT BE LATE! – The Client understands that session times are booked according to a shooting schedule. 4Dimensions studio Dmcc will not be held liable for the Client’s loss in session time & session fee, the Client(s) are responsible for arriving on time. In the case of the Client not being on time, the time will be deducted from the originally agreed session time and the Photographer will not be held responsible for loss or the missed amount of images agreed upon not obtained within the time remaining for the planned session. Calculate your travel & traffic time accordingly!

  11. Permits – The client is responsible for obtaining all necessary permits required for photo locations and to make arrangements to have said permit available on the session date( applicable for outdoor shooting only).

  12. Make-Up and Hair – Photographer will not be held liable for make-up failure, including and not limited to uneven tone, excessive blotched or irritated skin, intentional or unintentional shining of skin, smudged or clogged mascara or make-up smeared or transferred to clothing or guests.

  13. Copyright/Usage – PHOTOGRAPHER will retain the copyright of the photographs and permission is hereby given for PHOTOGRAPHER to use these photos for future advertising, studio display, competition, exhibits and/or reproduction.

  14. Exclusive Rights – It is understood that PHOTOGRAPHER is the exclusive Official Photographer retained to perform the services requested in this contract

  15. Postponement / Cancellation – In the event of postponement or cancellation of the affair/contract, PHOTOGRAPHER will use the retainer fee towards a replacement date that is suitable to our schedule.

  16. Studio Liability – PHOTOGRAPHER will take the utmost care with respect to the production, post-production and delivery of the photo(s). However, in the event PHOTOGRAPHER fails to comply with the terms in this contract, due to any event or act outside the control of PHOTOGRAPHER, is limited to the retainer fees ONLY.
    4Dimensions studio Dmcc will not be liable for any acts, events, omissions or accidents beyond my reasonable control, including strikes, failure of a utility service or transport network, an act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, inclement weather or default of suppliers or sub-contractors.
    The limitation on liability shall also apply in the event that Photos are lost through equipment malfunction, are lost in the mail or are otherwise lost or damaged. Our total liability for any breach, representation, act or omission (including negligence) shall be limited to my fee in relation to the Photo Services and we shall not be responsible for any special, indirect or consequential or pure economic loss, costs, damages, charges or expenses.
    In the event of incapacitating illness or injury to the Photographer, [[brand_business_name]]will have the option, whenever possible, to mutually agree with you a replacement photographer carry out the Photo Services.
    Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said person’s own risk. 4Dimensions studio Dmcc cannot be held responsible for any personal accidents during a photographic shoot.

  17. Travel Expenses – PHOTOGRAPHER charges AED2.50 / KM for travel expenses (First 100 KM minimal charges is 250).

  18. Fees – an administration fee of $25.00 will be applied to NSF Cheques.

 

Refund Policy

This copyright policy applies to the Photography Services provided by 4Dimensions studio DMCC, Dubai, United Arab Emirates. (“we”, “our” or “us”).

Our goal at 4Dimensions studio DMCC is your complete satisfaction with your purchase and that you are satisfied with your purchases.

Photographs taken and sent to you

Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned. Thus, we have a strict NO REFUNDS POLICY.  If you have selected and purchased an incorrect photo, you should notify us and we will do our very best to send you the correct photograph. Please note that refunds will NOT be given is you simply “don’t like”, or any other reason, a photograph that you have previously selected and already received. If you in the unlikely event that we have made a mistake, have received a photo which was not selected by you and as documented on the invoice, we will send you the correct photo free of charge.

Upon booking your photo shoot

 

Technical Issues, bad weather and unforeseen circumstances

In the case of camera failure, inclement weather, or any other unforeseen incident that prevents us from shooting on the scheduled date you will be edible to rebook your photo shoot or in certain situations at our discretion receive a refund of 80%, however rebooking the shooting is considered the preferred method.

 

  • No show and non attendance

No refund will be given under any circumstances if you fail to attend the session on the day and at the time listed, when the booking was made.

 

  • Rescheduling your photo shoot

If you need to reschedule your photo shoot, please let us know as soon as possible and no later than 7 days prior your photo shoot to see if we can move your photo shoot to a different day or time.  You may risk losing your booking fee of 20% if your date has been in high demand or if you do not reschedule.

 

  • Cancellation

– 100% non-refundable if cancelled within 24 hours before the photoshoot for the individual package and 48 hours before the photoshoot for the Group package.

– 80% refundable till 24 hours before the photoshoot for the individual package and 48 hours before the photoshoot for the Group package.

– Deposit of 20% non-refundable.

 

When booking your photo shoot

Since we provide non-tangible irrevocable goods and services we do not issue refunds once the session or event is booked. Upon booking you agree to  reserve the time and date of services along with a non refundable, non-transferable reservation fee equal to 20% of the total photography fee. No date is reserved until the fee is received. The balance due for the services must be paid in full no less than 24 hours before the event date. In the event that you fail to remit payment as specified, we have the right to immediately terminate our Agreement without further obligation, retain any monies already paid, and not attend the photo shoot. However, we realise that exceptional circumstance can take place and based on individual circumstances different arrangements may at our sole discretion be made.

HEALTH

If you are taken ill by an infectious disease, you must let me know and rearrange your session until you are fully recovered and no longer contagious. This is to protect the health of all my clients, who often include newborns.

Please inform me on booking if you or anyone attending your photography session suffers from any health conditions including allergies, photosensitive epilepsy, medical issues, physical difficulties and disabilities etc.

STAYING COVID SECURE

All sessions will be planned to maintain, wherever possible, the following additional precautions:

– wearing a face visor throughout your shoot;

– no unnecessary physical contact (e.g. handshaking);

– ensuring sufficient time to air the studio between sessions;

– deep cleaning high contact and hard surfaces in the studio between sessions;

– ‘quarantining’ delicate fabrics and props for at least 72 hours before using them again;

– providing disposable gloves, masks and hand sanitiser with at least 60% alcohol for client use;

– asking clients to confirm they are symptom-free, to remove their shoes on arrival and to wash their hands before entering the studio.

If we need to reschedule your photoshoot booking due to you or someone in your household experiencing symptoms of Covid-19, and/or due to a regional or national lockdown which prevents me from operating my studio or prohibits non-essential travel, then this will need to show proof of positive results and presented within 24 hours before the original booking date.
